1. Acceptance of Terms
By accessing and using MindSpectrum's psychological assessment platform and related services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and Medical Disclaimer. If you do not agree with any part of these terms, you must discontinue use immediately. These terms constitute a legally binding agreement between you and MindSpectrum. By using our services, you confirm that you are at least 16 years of age (or have obtained verifiable parental/guardian consent if aged 16-17) and have the legal capacity to enter into this agreement.
2. Service Description
MindSpectrum provides access to evidence-based psychological self-assessment tools including clinically validated screening questionnaires (RAADS-R, AQ, CAT-Q, etc.), automated scoring and result generation, historical tracking of assessment results over time, educational resources about psychological traits and conditions, and AI-powered interpretive summaries based on published research literature. Services are provided 'as is' for self-knowledge and educational purposes. We make no warranties about the accuracy, completeness, reliability, or clinical utility of assessment results for any particular individual.
5. Payment & Billing
Access to basic assessments may be provided free of charge. Premium features including detailed reports, historical tracking, AI interpretations, or additional assessment tools may require paid subscriptions. Subscription fees are billed in advance on a recurring basis (monthly or annually as selected). All fees are non-refundable except as required by applicable consumer protection laws or as explicitly stated in our refund policy. We reserve the right to modify pricing with 30 days advance notice to existing subscribers. You authorize us to charge your designated payment method for all applicable fees and taxes. Given the sensitive nature of mental health services, we will not report payment disputes or non-payment to credit bureaus.
6. Refund Policy
We offer a 7-day satisfaction guarantee for all paid subscriptions. If you are not satisfied with your premium subscription, you may request a full refund within 7 days of your initial purchase by contacting [email protected] with your account email and reason for refund. Refunds are processed within 5-10 business days to your original payment method. Refunds are only available for first-time purchases and do not apply to subscription renewals, annual subscriptions after the first 7 days, or users who have violated our Terms of Service. 8. Intellectual Property
You retain ownership of your personal assessment responses and results. We retain all rights, title, and interest in: the MindSpectrum platform and software, assessment instruments and scoring algorithms (subject to original publishers' rights), trademarks and branding, educational content and resources, and AI models and interpretive systems. You grant us a limited, non-exclusive license to process your assessment data solely for providing services to you, improving platform functionality through aggregate anonymized analysis, and conducting internal research. You may download and retain copies of your own assessment results for personal use but may not redistribute assessment instruments or scoring methods.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDSPECTRUM AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM: use or inability to use our services, reliance on assessment results for medical decisions, failure to seek appropriate professional help based on misinterpretation of results, any harm resulting from mental health crises or emergencies, data breaches despite our reasonable security measures, inaccuracies or errors in assessment results, or any other use of our platform. Our total liability shall not exceed the amount you paid for services in the 12 months preceding the claim, or $100 if no fees were paid. Some jurisdictions do not allow limitation of liability for personal injury or health-related claims; these limitations may not apply to you.
